To determine who is considered the event organizer, two approaches can be taken. First, the person in charge of the event's planning and execution is typically deemed the organizer. Alternatively, the individual or organization that has the legal authority to make decisions and assume liability for the event is also considered the organizer.

The specific responsibilities of event operators, organizers, and designees are outlined in Section 38 of the German law governing event safety. These responsibilities include:

  • Ensuring the safety of attendees and participants
  • Complying with all applicable fire safety regulations
  • Developing and implementing a comprehensive emergency plan
